2. Acceptance of Order

Your acceptance of these Sale Terms by clicking on the "Accept" button represents an offer of contract from you only and is not binding until accepted by us either by sending you an email which is received by you explicitly stating this. Receipt of an order via the We Love Sleep website by us does not constitute acceptance of an order. We reserve the right to refuse your offer for any reason. Any errors or omissions in any catalogue, sales literature, price list, dispatch note, invoice or other documentation or any information issued by us from time to time shall be subject to correction without liability on our part. You will be responsible for ensuring the accuracy of any order submitted by you, confirming where reasonably requested to do so by us any telephone orders, and for the giving of such information as is necessary relating to the Sale Terms and delivery (as the case may be) to enable us to deliver the goods to the delivery address notified by you. When writing to us You must quote your order number.

3. Definitions In these terms:-

a. "You" and "your" refer to the person who buys or has agreed to buy goods from us.

b. "We", "our" and "us" refer to Janick Ltd (trading as We Love Sleep), our employees and agents.

N.B. Throughout these Terms and Conditions none shall in full or part override or affect your statutory rights especially in accordance with the Sale of Goods Act.

4. Variations

Neither you nor we may alter the terms of this agreement without the agreement of the other. If you require any changes, please make sure that you ask for these to be put in writing. This is to insure that you can avoid any problems surrounding what you have agreed and what is expected of us. .

5. Accuracy of Information

We Love Sleep takes great care to faithfully reproduce all descriptions and specifications as provided by the manufacturers however, errors may occur. If you are in any doubt we recommend you contact our customer service team to discuss the products in more detail. The illustrations are representative only. All sizes are correct according to the manufacturers specifications. All Items are subject to availability. All details, specifications, prices are accurate at time of publication, but may subsequently change. While we make every effort to ensure that the furniture shown are as close as possible to the actual specification there may be slight variations due to the nature of the medium. We reserve the right to alter specifications as advised by the manufacturers. Responsibility for checking the dimensions of your mattress lies solely with the customer, We Love Sleep cannot be held responsible for customers ordering the incorrect size or not checking the dimensions before purchase.

6. Delivery

When items are in stock we will despatch the order the following day. Please allow 3-5 working days for the goods to arrive within the UK. We also offer overnight delivery, please see individual products for the cost of this. If an item is out of stock we will notify you of the delay and despatch as soon as it arrives. Please note that for next day delivery, orders must be received by 12 noon and will be delivered on the next business day. All delivery charges are applicable to all postcodes apart from those listed in the Delivery section of our website, which is prominently placed on our homepage. It is the customer's responsibility to check whether their postcode has additional charges that are applicable to it. .

7. Price

The price is in £ Sterling and is agreed at the time the contract is made and includes Value Added Tax and other taxes, duties or tariffs.

8. Ownership

The goods remain the sole property of the company until full payment has been received by us at which time title passes to you. You will be responsible for the care of the goods once you have received delivery of them.

9. Returns Policy

We will replace or where appropriate repair any goods that fail within 12 calendar months of delivery by reason of faulty materials or workmanship, provided that you notify us within a reasonable period of the failure. Please note some of our suppliers offer guarantees above and beyond this, and we will honour them if this is the case. In all cases remedies offered by us shall not affect your statutory rights or our responsibilities under the Sale of Goods Act.

Unwanted goods

If you decide for any reason you no longer want the goods purchased, you can return them within 30 (thirty)days in their original packaging and unused. We will then give you a full refund, minus the cost of returning the goods to us.

10. Limitations

We will not pay for:- a. Fair wear and tear or damage caused by negligence and/or improper use (unless it is our suppliers' or our own negligence or improper use). b. Damage that occurs as a result of repairs or alterations made without our approval. c. Loss or damage relating to your business.

11. Cancellation

a. In compliance with "The Distance Selling Regulations" customers are allowed a 7 day "cooling off" period in which to cancel any order. Customers wishing to take up this option must e-mail or ensure written notice of same is received at the company address contained in the order confirmation, and within the regulation "cooling off" period allowed. In any dispute proof of cancellation must be provided and in this respect customers are advised to keep a copy of all correspondence sent, together with proof of dispatch where applicable. b. Other than (a) above, once you order goods from us, you cannot cancel the order unless we are in breech or our obligations to you.

You can use the WeLoveSleep.co.uk website without submitting personal data. However, if you open an account on the website, we do ask you to supply the data necessary for us to invoice you and deliver your order: your name, address, email address, etc.

WeLoveSleep.co.uk undertakes only to disclose your personal data to third parties involved in the ordering process: bank, delivery service, etc.

We will not share your information with any third parties for marketing purposes

WeLoveSleep.co.uk may also disclose data wherever necessary to identify or question any individual who, intentionally or unintentionally, damages the property or infringes the rights of Janick Ltd T/A We Love Sleep, other WeLoveSleep.co.uk website users or any persons penalized as a result of such actions.

13. Severability

Each of these terms is severable. This means that if one term is not considered to be legally enforceable, that will not necessarily mean that the other terms are not enforceable.

We know of no documented cases of credit card fraud using our shopping system over the Internet. All credit card numbers are encrypted when the order is placed using 128bit SSL encryption. We employ additional security from both Visa & MasterCard to ensure your shopping experience remains secure.

The information contained in our website is intended for guidance only, and products/prices described in it are subject to change without notice. We reserve the right to withdraw any offers without prior notice.
